For one thing, I think it's very hard to define "hate crime" -- for
instance, if a group of white men beat and kill a black man, it's a hate
crime. If a group of black men beat and kill a white man, are people going
to view it as a hate crime, or are they going to view it as just another
race-related crime?
and to a certain extent, aren't most crimes motivated by hate of some
sort?

I think this would effectively be the result. Ideally, i think all violent
crimes would be handled the same way, but perhaps this legislation is
needed to somehow compensate for racism / heterosexism / and other -isms
which may be present in some courts.
